Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and Sum of Technologies ("we", "us", "our"), Dubai, United Arab Emirates, and govern your use of the mobile applications we publish (each an "App", together the "Apps") and the related services and content. They apply to every App published under the Sum of Technologies developer account unless that App links to its own terms. By downloading, installing or using an App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

Our Apps are distributed through the Apple App Store. Apple's Licensed Application End User License Agreement ("Apple EULA") also applies; where these Terms are stricter or more specific than the Apple EULA, these Terms prevail between you and us. Apple is not a party to these Terms and is not responsible for the Apps or their content.

1. Eligibility

You must be at least 18 years old, or the age of majority in your jurisdiction, to use the Apps. If you are between 13 (or the minimum age in your country) and 18, you may use the Apps only with the consent and supervision of a parent or legal guardian who agrees to these Terms on your behalf. The Apps are not intended for children under 13.

2. License

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App on Apple devices that you own or control, for your personal, non-commercial use. All rights not expressly granted are reserved by Sum of Technologies and its licensors.

3. Subscriptions, purchases and credits

• Auto-renewing subscriptions. Some features require a paid subscription. Payment is charged to your Apple ID account at confirmation of purchase. Subscriptions renew automatically for the same period and price unless cancelled at least 24 hours before the end of the current period.
• Free trials. If a free trial is offered, your subscription begins and you are charged when the trial ends unless you cancel at least 24 hours before. Any unused portion of a free trial is forfeited when you purchase a subscription.
• Managing and cancelling. You can manage or cancel subscriptions in iOS Settings → Apple ID → Subscriptions. Deleting the App does not cancel a subscription. Cancellation takes effect at the end of the current billing period, and no refund is given for the remainder of that period.
• Credits and consumables. Some Apps sell credits, tokens or packs used to generate content. Credits are consumed when a generation is requested, have no cash value, cannot be transferred and are not refundable once used. Credits included with a subscription may expire at the end of each billing period as described in the App.
• Prices and changes. Prices are shown in the App in your local currency and may change. We will notify you of price increases as required by Apple, and you may cancel before they apply.
• Refunds. Purchases are processed by Apple and refunds are handled by Apple under its policies. We cannot issue refunds directly. You can request a refund at reportaproblem.apple.com.

4. AI-generated content

• Your input. You retain ownership of the prompts, photos, videos, audio and other material you submit ("Input"). You grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit and modify your Input solely to provide the App's features to you, including sending it to the AI providers that process it on our behalf.
• Output. To the extent permitted by law, we assign to you any rights we have in the images, videos, audio or text generated for you ("Output"), and you may use it for personal and commercial purposes, subject to these Terms and the rights of third parties. Because of how generative AI works, Output may not be unique and similar Output may be generated for other users.
• No guarantee of accuracy. Output is produced by automated systems and may be inaccurate, incomplete, offensive or unsuitable for your purpose. You are responsible for reviewing Output before relying on or publishing it. Output is not professional advice of any kind.
• Your responsibility. You are solely responsible for your Input, your use of Output and for ensuring that you have all rights and permissions needed, including the consent of any person whose image, voice or likeness you upload.

5. Acceptable use

You agree not to use the Apps to:

• violate any law, regulation or the rights of others, including intellectual property, privacy and publicity rights;
• create, upload or distribute sexual content involving minors, non-consensual intimate imagery, or content that sexualizes real people without their consent;
• create deceptive media of real people (for example deepfakes) intended to mislead, defame, harass, impersonate or defraud, or content that misrepresents AI-generated material as authentic where that could cause harm;
• generate or share content that promotes violence, terrorism, self-harm, hatred or discrimination, or that is otherwise abusive;
• interfere with the security or operation of the Apps, bypass usage limits, subscription checks or content filters, or access the services by automated means;
• reverse engineer, decompile or extract the source code of the Apps except where expressly permitted by law;
• resell, rent, sublicense or otherwise commercially exploit the Apps or access to them;
• use Output to develop competing models or services.

We may use automated and manual review to detect prohibited content and may remove content, refuse requests, limit features or suspend or terminate access for violations, without refund.

6. Health, wellness and informational content

Some Apps provide tracking, reminders, calculations or informational content about health, nutrition, skincare, fitness or similar topics. This content is for general informational purposes only and is not medical advice, diagnosis or treatment. Always consult a qualified healthcare professional before making decisions about medication, diet or health, and never disregard professional advice because of something you saw in an App. In an emergency, contact local emergency services.

7. Intellectual property

The Apps, including their software, design, text, graphics, logos, trademarks and other content (excluding your Input and Output), are owned by Sum of Technologies or its licensors and are protected by copyright, trademark and other laws. You may not copy, modify, distribute or create derivative works from them without our prior written permission. If you believe content in an App infringes your rights, contact us with details of the claim using the details in section 15.

8. Third-party services and content

The Apps may rely on or link to third-party services, including AI model providers, analytics and payment platforms. We are not responsible for third-party services or content, and your use of them may be subject to their own terms. Output based on third-party models is provided under the terms of those models to the extent they apply.

9. Updates and availability

We may update, change, suspend or discontinue any App or feature at any time, with or without notice. We may require you to install updates to continue using an App. We do not guarantee that an App will always be available, uninterrupted or error-free, or that generation requests will always succeed. Usage limits, generation speed and quality may vary.

10. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APPS AND ALL CONTENT AND OUTPUT ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT AND ACCURACY.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SUM OF TECHNOLOGIES AND ITS OFFICERS, EMPLOYEES, CONTRACTORS AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF DATA, PROFITS, REVENUE OR GOODWILL, ARISING OUT OF OR RELATED TO THE APPS OR THESE TERMS, HOWEVER CAUSED. OUR TOTAL LIABILITY FOR ALL CLAIMS RELATING TO AN APP WILL NOT EXCEED THE AMOUNT YOU PAID US FOR THAT APP IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE, OR USD 50, WHICHEVER IS GREATER. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited by law, or your statutory consumer rights.

12. Indemnification

You agree to indemnify and hold harmless Sum of Technologies and its affiliates from any claims, damages, losses and expenses (including reasonable legal fees) arising from your Input, your use of Output, your violation of these Terms or your violation of any law or the rights of a third party.

13. Termination

You may stop using an App at any time by deleting it; this does not cancel an active subscription (see section 3). We may suspend or terminate your access to an App at any time if you breach these Terms or if we discontinue the App. Sections that by their nature should survive termination (including 4, 7 and 10–14) will survive.

14. Governing law and disputes

These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be submitted to the exclusive jurisdiction of the courts of Dubai, United Arab Emirates. If you are a consumer residing in the European Economic Area, the United Kingdom or another jurisdiction that grants you mandatory protections, you keep the benefit of those protections and may bring proceedings in the courts of your country of residence. Before starting any formal proceedings, please contact us so that we can try to resolve the matter.

15. General

• Changes. We may revise these Terms from time to time. The effective date at the top of the page shows the latest revision. Material changes will be announced in the App or on this website. Continued use after the changes take effect means you accept the revised Terms.
• Entire agreement. These Terms, the Privacy Policy and any App-specific terms are the entire agreement between you and us regarding the Apps.
• Severability and waiver. If any provision is held invalid, the remaining provisions remain in effect. Our failure to enforce a provision is not a waiver of it.
• Assignment. You may not assign these Terms. We may assign them in connection with a merger, acquisition or sale of assets.
• Apple terms. You acknowledge that Apple has no obligation to provide maintenance or support for the Apps, that Apple is not responsible for addressing any claims relating to the Apps or your use of them, and that Apple and its subsidiaries are third-party beneficiaries of these Terms with the right to enforce them against you.
